Welcome to Navimental! These Terms & Conditions ("Terms") govern your use of our website at https://navimental.com ("Website") and any peer support services (collectively, the “Services”) provided by Navimental, Inc. ("Navimental," "we," "our," or "us").

Please read these Terms carefully. By accessing our Website or Services, you agree to be bound by these Terms, including our Privacy Policy (accessible at https://navimental.com/privacy). If you do not agree, do not access or use our Services.

Our Services are not a substitute for professional medical care. Navimental cannot guarantee and makes no representations or warranties that your use of its Services will result in any specific health-related improvements, outcomes or benefits.

1. About Navimental’s Services

Navimental provides peer support from Family Peer Support Specialists and other certified peers or Family Support Navigators. Our Services are intended to offer emotional support, guidance, and skills-building based on lived experience. We do not:

  • Provide medical care, diagnosis, or treatment.
  • Offer crisis intervention services.
  • Accept or bill insurance (all services are self-pay).

If you or someone you know is in imminent danger of harming themselves or someone else, call 911 Emergency Services. “Imminent danger” means having 1) the intent to cause harm and 2) the means to act immediately. If you are having thoughts about suicide but are not in imminent danger, or you need emotional support, call or text 988, the National Suicide & Crisis Lifeline (available 24 hours / 7 days a week).

2. Eligibility

You may use or access the Services if:

  • You are at least 18 years old
  • You are located within the United States.
  • You agree to comply with these Terms and applicable laws.

We may suspend or terminate access for violations of these Terms at our sole discretion.

3. Accounts

When creating an account, you agree to:

  • Provide accurate, current information.
  • Maintain the security of your login credentials.
  • Notify us immediately of any unauthorized use of your account.

You are responsible for any activity that occurs under your account. If you suspect unauthorized use, you must notify us immediately so we can help secure your account.

4. Payments and Fees

Navimental Services are self-pay only. We do not accept insurance, Medicaid or Medicare.

Payments are processed through a third-party vendor, Stripe. By making a payment, you agree to the Stripe’s terms and privacy policy. Navimental uses Stripe to store your credit card information for future transactions. We may assist in resolving payment-related concerns, but any issues related to payment processing, including disputes or errors, should be directed to the payment processor.

Cancellation policies:

  • Sessions canceled at least 24 hours prior to a booked session will not incur a fee.
  • No-shows or late cancellations (less than 24 hours) may be billed in full, 24 hours prior to the session.

Refunds are generally not issued unless required by law. We may consider refund requests on a case-by-case basis.

5. Proper Use of Services

You agree not to engage in any activity that:

  • Violates any laws or third-party rights.
  • Harasses, harms, or exploits others.
  • Uploads or introduces harmful content, malware, or spam.
  • Attempts to scrape, hack, or disrupt our systems, data or infrastructure.
  • Misrepresents your identity or impersonates another person.
  • Uploads, shares, or transmits sexually explicit, or otherwise inappropriate content, including images, videos, or text that could be harmful or offensive.

If we become aware of a potential violation of the above restrictions, we may investigate, suspend or terminate your account, and take legal action.

6. Intellectual Property

Navimental owns all content on our Website and Services, including text, graphics, branding, and software. You may not copy, modify, distribute, or create derivative works without our written consent.

You retain rights to any content you submit but grant Navimental a non-exclusive, royalty-free license to use, reproduce and display such content solely for the purpose of operating and improving our Services. This license continues for as long as the content to be hosted on or used by the Services, in accordance with our Privacy Policy.

7. Communications and Messaging Consent

By using our Services, you consent to receive:

  • Emails related to your account, sessions, and important updates.
  • SMS/text messages for confirmations and reminders (message and data rates may apply).

You can opt out of marketing messages but cannot opt out of essential communications (like appointment reminders). To opt out of essential communications, you must terminate your account.

8. Disclaimer of Warranties

Navimental does not provide medical, psychological, legal, or other licensed professional services. Any advice, guidance, or information provided through our Services—whether by peer support specialists, navigators, or content on the platform—is intended solely for informational and peer support purposes. It is not a substitute for professional healthcare, legal, or clinical advice, diagnosis, or treatment. You should always seek the advice of a qualified professional with any questions you may have regarding a medical condition, legal matter, or other professional concern. Reliance on any information provided by Navimental is strictly at your own risk. Navimental provides Services "as is" and "as available." We expressly disclaim any implied guarantees of therapeutic or clinical effectiveness.

We do not guarantee that the Services will meet your expectations nor that the Services will be uninterrupted or error-free.

While we take privacy and security seriously, Navimental is not a covered entity or otherwise directly subject to the Health Insurance Portability and Accountability Act (“HIPAA”), and Navimental makes no representations or warranties that its provision of the Services is compliant with HIPAA.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Navimental and its affiliates, officers, directors, employees, agents and contractors shall not be liable for:

  • Any indirect, incidental, special, punitive or consequential damages, including but not limited to lost profits, lost data, or loss of goodwill, arising out of or in connection with your use of the Services
  • Any damages exceeding the total amount you paid to Navimental in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not permit the exclusion or limitation of certain types of liability. Accordingly, the above limitations may not apply to you in full and shall only apply to the extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend and hold harmless Navimental, its affiliates, officers, directors, employees, agents and contractors from and against any claims, liabilities, damages, or expenses (including reasonable attorney’s fees) arising out of or related to:

  • Your use or misuse of our Services.
  • Your violation of these Terms or any applicable laws.
  • Your infringement of any third-party rights, including, but limited to, intellectual property rights and privacy rights.
  • Any content or information you submit or transmit through the Services.

11. Dispute Resolution and Arbitration

  • You agree to first try in good faith to resolve it collaboratively by contacting us at info@navimental.com.
  • If unresolved, disputes shall be resolved and finally settled through binding arbitration in Maine. The arbitrator, and not any court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to these Terms and the Services. The arbitrator’s award shall be binding on the parties and may be entered as a judgment in any court of competent jurisdiction.
  • Arbitration will be conducted by a single neutral arbitrator through the American Arbitration Association (AAA). The arbitrator’s award shall be binding on the parties and may be entered as a judgment in any court of competent jurisdiction.
  • You hereby waive your right to a jury trial and to participate in any class action or other such representative proceeding related to any dispute with Navimental.

This agreement to arbitrate and the associated waivers shall survive the termination of your use of Navimental’s Services and remain in effect indefinitely. If any portion of this arbitration agreement or class action waiver is found to be unenforceable, the remainder of these Terms shall remain in full force and effect.

12. Force Majeure

Navimental shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, internet or telecommunications outages, governmental actions or legal restrictions, pandemics, labor disputes, or disruptions in third-party services. Such events shall not constitute a breach of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post them on our Website and update the Effective Date. Your continued use after such changes means you accept the updated Terms.
